Terms of service for WebStack Services

These Terms of Service ("Terms") outline the access and use of website hosting, website design, and domain name registration services provided by WebStack Services ("WebStack", "we", "us", or "our"). By accessing or using these services, you agree to be bound by these Terms and the Privacy Policy.

  1. Services offered
    WebStack provides the following services:
    Website Hosting: Hosting for websites and applications.
    Website Design: Website creation and development.
    Domain Name Registration: Registration and management of domain names.
  2. Eligibility and user accounts
    To use WebStack's services, users must:
    Be at least 18 years old.
    Provide accurate account and domain registration information.
    Maintain the security of account credentials.
  3. Acceptable use policy
    Users must adhere to the Acceptable Use Policy (AUP) when using WebStack's services. This policy outlines the acceptable and prohibited uses of these services, including:
    Prohibited activities such as spamming, phishing, distributing malware, or engaging in network attacks.
    Restrictions on content that is illegal, infringes intellectual property rights, or violates privacy.
    Responsibilities regarding data security and maintaining the services' integrity.
  4. Domain name registration
    Domain name registrations are subject to the policies of ICANN and relevant registry operators.
    Users are responsible for providing accurate and updated contact and registration information.
    Users must comply with the terms and conditions set forth by WebStack, the registry, and ICANN.
    Domain name renewal fees are subject to change.
  5. Website design services
    Website design projects require detailed agreements specifying the scope of work, timelines, and payment terms.
    The ownership of intellectual property (IP) for website design elements, such as graphics, code, and content, will be defined in the website design agreement.
    Client content provided for website design must not infringe any third-party IP rights.
  6. Website hosting services
    WebStack aims to provide high availability of its hosting services. However, service disruptions may occur due to maintenance or circumstances beyond control.
    Downtime due to planned maintenance or force majeure is not included in uptime guarantees.
    WebStack takes reasonable precautions to implement data backup services but is not responsible for unintended data loss.
    Customers should maintain backups of their website data and have a contingency plan in case of service termination or disruption.
  7. Fees and payments
    Fees for WebStack's services are specified in separate service agreements or the pricing structure.
    Billing cycles and payment methods will be outlined during signup or in the service agreement.
    WebStack uses recurring billing for services, such as hosting and domain renewals.
    Users authorize WebStack to charge the chosen payment method for recurring fees.
    Users can manage account and billing information through their WebStack dashboard.
  8. Limitation of liability
    WebStack is not liable for damages from service disruptions or malicious activity on websites hosted by clients, as per the Communications Decency Act.
    WebStack's liability is generally limited to the fees paid for services during the period of disruption or malfunction.
    WebStack is not responsible for losses due to the unavailability of website data or software after service termination.
  9. Intellectual property
    WebStack respects the intellectual property rights of others and expects users to do the same.
    Users are responsible for ensuring that all content used with services complies with copyright, trademark, and other intellectual property laws.
    WebStack reserves the right to suspend or terminate services for infringement of intellectual property rights.
  10. Termination
    WebStack may suspend or terminate access to the services for violations of these Terms or the AUP.
  11. Disclaimer of warranties
    WebStack provides services "as is" and disclaims all warranties, express or implied, including fitness for a particular purpose.
  12. Governing law and dispute resolution
    These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles.
    Any disputes arising from these Terms will be resolved through mediation or arbitration, as agreed upon by the parties.
  13. Changes to these terms
    WebStack reserves the right to amend these Terms from time to time. Users will be notified of material changes via email or through the WebStack website.
